This Privacy Policy explains how TakeawaysNearMe.ie (“we”, “us”, “our”) collects, uses, stores, and protects personal data when you use our website. We are committed to protecting your privacy and processing your data lawfully, fairly, and transparently.

2. Scope & Legal Framework

This policy applies to all personal data processed by TakeawaysNearMe.ie through our website, including data from website visitors, registered users, and business owners who interact with our platform.

We process personal data in compliance with:

  • Regulation (EU) 2016/679— the General Data Protection Regulation (“GDPR”)
  • Data Protection Act 2018(Ireland) — the national implementing legislation which supplements the GDPR in Ireland
  • S.I. No. 336/2011— European Communities (Electronic Communications Networks and Services) (Privacy and Electronic Communications) Regulations 2011 (“Irish ePrivacy Regulations”), governing cookies and similar technologies

3. Data We Collect

3.1 Data You Provide Directly

When you create an account or interact with our site, we collect:

  • Claim verification data: information you provide to verify that you own or are authorised to manage a business listing (see Section 6)

3.2 Data Collected Automatically

When you visit TakeawaysNearMe.ie, our servers and third-party infrastructure automatically collect:

  • Technical data: IP address, browser type and version, operating system, device type, and referring URL
  • Usage data: pages visited, time spent on pages, and clickstream data
  • Location data: approximate location derived from IP address; precise geolocation only if you explicitly grant browser permission for the “Near Me” feature

3.3 Publicly Available Business Data (Indirect Collection)

In accordance with GDPR Article 14, we notify business owners that we source and display the following publicly available data from the Google Places API:

  • Business name, address, and geographic coordinates
  • Telephone number and website URL (where publicly listed)
  • Opening hours and service types (dine-in, takeaway, delivery)
  • Aggregate ratings and review counts from Google Maps
  • Cuisine categories and business type classifications

This information is publicly available on Google Maps and Google Search. Individual user reviews from Google are not reproduced on our site; we display aggregate ratings only. Business owners who wish to have their listing removed may do so under Section 6 of this policy.

We also use AI content generation services (see Section 7) to produce written descriptions of business listings. This process uses publicly available business information and does not involve processing of personal data beyond what is already collected from public sources.

4. Legal Basis for Processing

We process personal data only where we have a valid lawful basis under GDPR Article 6. The table below sets out our processing activities and the basis for each:

4.1 Our Legitimate Interest Assessment

Where we rely on legitimate interest, we have conducted a balancing test in accordance with GDPR Article 6(1)(f) and EDPB Guidelines 1/2024. Our assessment concludes:

  • Purpose test: We have a genuine interest in operating an accurate, consumer-facing food outlet directory for the benefit of Irish consumers seeking local takeaway and dining options.
  • Necessity test: Displaying publicly available business information is necessary to fulfil this purpose; we cannot achieve it with less intrusive means.
  • Balancing test: Business contact information (name, address, phone, hours) is already publicly available via Google Maps and Google Search. Data subjects have a reasonable expectation that publicly listed business information will appear in directories. We mitigate any impact by providing a clear, cost-free opt-out mechanism (Section 6).

You have the right to object to processing based on legitimate interest at any time (see Section 9).

4.2 Withdrawing Consent

Where processing is based on your consent, you have the right to withdraw that consent at any time under GDPR Article 7(3). Withdrawal of consent does not affect the lawfulness of any processing carried out before the withdrawal. To withdraw consent, delete your account through your account settings or contact us at hello@takeawaysnearme.ie.

5. How We Use Your Data

We use the personal data we collect for the following purposes:

  • To create, manage, and authenticate your user account
  • To save and display your saved favourite outlets
  • To process, verify, and administer business listing claims
  • To deliver the “Near Me” proximity search feature (using your location only with your permission)
  • To respond to your support enquiries and correspondence
  • To maintain the security, integrity, and performance of our website
  • To detect and prevent fraudulent activity
  • To improve the accuracy, completeness, and quality of our business directory

We do not sell your personal data to any third party. We do not use your personal data for targeted advertising or behavioural profiling. We do not share your personal data with listed businesses.

6. Business Listing Data & Opt-Out

6.1 Nature of Business Data

Business listing data displayed on TakeawaysNearMe.ie is sourced from the Google Places API and consists of information that businesses have made publicly available through Google Business Profile. For limited companies and partnerships, this data typically relates to the business entity rather than to an identifiable natural person. However, for sole traders, business contact information (such as the owner's name, phone number, or email) may constitute personal data under GDPR.

Regardless of business type, we respect the right of any business to request removal of their listing from our platform.

6.2 Google Places API Compliance

Our use of Google Places API data complies with the Google Maps Platform Terms of Service. Business information is attributed to Google on individual outlet pages and in our site footer.

6.3 Business Owner Opt-Out (Listing Removal)

Any business owner or authorised representative may request the removal of their listing from TakeawaysNearMe.ie, free of charge, at any time. The process is:

  1. Create an account and claim your listing — verify that you are the business owner or an authorised representative through our listing claim process.
  2. Request removal — once your claim is approved, submit a removal request through your account dashboard or by emailing hello@takeawaysnearme.ie.
  3. Processing — we will remove your listing from the public site and add your business to our exclusion list within a reasonable timeframe, ensuring it is not re-imported in future data updates.

We maintain a permanent exclusion record containing only your Google Place ID (a non-personal technical identifier) to ensure your business does not reappear. All other data associated with your listing will be deleted within 30 days of removal.

Where a sole trader believes that the business listing contains their personal data and wishes to exercise their GDPR right to erasure (Article 17), they may do so directly by contacting us at hello@takeawaysnearme.ie. No fee applies to the exercise of any GDPR data subject right.

6.4 Re-listing After Opt-Out

If a business that has voluntarily opted out later wishes to be re-listed on TakeawaysNearMe.ie as a commercial directory service, a re-listing administration fee of €500 applies. This is a fee for the commercial re-listing service (covering re-verification, data restoration, and quality assurance) and is entirely separate from, and without prejudice to, the free exercise of any GDPR data subject rights. 7. Processors & Third-Party Sharing

We share personal data with the following categories of service providers (“processors”) solely to operate this website. All processors are bound by written data processing agreements requiring them to process data only on our documented instructions and in compliance with GDPR Article 28.

We do not share personal data with any third party for their own marketing or commercial purposes. We may disclose personal data to law enforcement or regulatory authorities where required to do so by law or court order.

8. International Data Transfers

Some of our processors (including Vercel, Google, and AI content generation services) are located in or transfer data to countries outside the European Economic Area (“EEA”), including the United States. The GDPR restricts such transfers unless an appropriate safeguard is in place.

We rely on the following transfer mechanisms:

  • EU–US Data Privacy Framework (DPF):Where a US processor is certified under the EU–US Data Privacy Framework (adopted by the European Commission in July 2023 and upheld by the General Court in September 2025), data transfers to that processor are covered by an adequacy decision. You can verify DPF certification status at dataprivacyframework.gov.
  • Standard Contractual Clauses (SCCs): Where a processor is not DPF-certified, we enter into the current European Commission Standard Contractual Clauses (2021 version) to provide appropriate safeguards for the transfer.

9. Your Rights Under GDPR

Under GDPR Chapter III and the Data Protection Act 2018, you have the following rights regarding your personal data. These rights are exercisable free of charge. We will respond to all valid requests within 30 calendar days. Where requests are complex or numerous, we may extend this by a further 60 days, in which case we will notify you within the initial 30 days.

You may also lodge a complaint with the supervisory authority in the EU member state of your habitual residence or place of work.

10. Data Retention

We retain personal data only for as long as is necessary for the purposes for which it was collected, or as required by law. Our retention periods are:

11. Security

We implement appropriate technical and organisational measures to protect your personal data against unauthorised access, accidental loss, destruction, or damage, in accordance with GDPR Articles 25 and 32. These measures include:

  • Encryption of data in transit using TLS (HTTPS)
  • Encrypted storage of authentication credentials
  • Row-level security policies on our database to enforce access controls
  • Role-based access control for administrative functions
  • PKCE-based authentication flows to prevent token interception
  • Regular review of access permissions and third-party integrations

In the event of a personal data breach that is likely to result in a risk to your rights and freedoms, we will notify the Data Protection Commission within 72 hours of becoming aware of the breach and will notify you without undue delay where there is a high risk to you.

12. Data Protection Officer

We have assessed our processing activities against the criteria set out in GDPR Article 37 and the Data Protection Act 2018. We do not carry out large-scale systematic monitoring of individuals, nor do we process special categories of personal data at scale. 13. Cookies

14. Children

Under Section 31 of the Data Protection Act 2018 (Ireland), the age of digital consent is 16 years. Our service is not directed at children under the age of 16, and we do not knowingly collect personal data from children under 16. If you believe a child under 16 has provided us with personal data without parental consent, please contact us immediately at hello@takeawaysnearme.ie and we will take steps to delete that data promptly.

15. Automated Decision-Making & Profiling

We do not make any decisions about you that produce legal or similarly significant effects based solely on automated processing, as described in GDPR Article 22. We do not build individual behavioural profiles of website users for advertising or any other purpose.

Our “top rated” and “near me” ranking features are algorithmic but apply equally to all listed businesses and do not process personal data of website users in any individualised way.

16. Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or for other operational reasons. Material changes will be communicated by a prominent notice on our website prior to the changes taking effect. Where required by law, we will seek your consent before making material changes to how we process your personal data.

The “Last updated” date at the top of this page indicates when the policy was last revised. We encourage you to review this policy periodically.
